Town Planning Scheme Amendments

Scheme Amendment 10 – WAPC Ref TPS/1150

On 15 August 2016 pursuant to clause 87(2) of the Planning and Development Act 2005, the Minister for Planning granted final approval for Amendment 10 to Town Planning Scheme No. 3.

Important Note:

Substantial sections of the Amendment were rejected, that is not approved by the Minister.  The classification of land and the residential density codes remain as designated on the Town Planning Scheme Map with the exception of the Royal George Hotel site (north east corner of George and Duke Street).  The Minister also approved changes to the Zoning Table along with administrative and technical changes to the Scheme Text.

Scheme Amendment 11

At the Council Meeting of 17 November 2015, the Council of the Town of East Fremantle resolved to adopt Amendment No. 11 without modification.  Full details of the Council resolution are available by accessing the following link:

We advise that Council received the Minister for Planning’s decision on Scheme Amendment No. 11 to Local Planning Scheme No. 3 and accordingly it was published in the Government Gazette 13 June 2017.

The amendment reads as follows:

Pursuant to clause 87(2) of the Planning and Development Act 2005 (the Act), the Minister for Planning has granted final approval of Amendment No. 11 to the Town of East Fremantle’s Local Planning Scheme No. 3 on 1 June 2017 for the purpose of:

  • Modifications to the provisions of Amendment 10 that is, R20 be modified to R17.5 for sections of the Richmond Hill and Richmond Precincts.
  • Amending the Scheme Maps to change zoning from R12.5 to R17.5 where marked on the Scheme Map.

Scheme Amendment 12

Local Planning Scheme Amendment No. 12

Amendment No. 12  Ref: TPS/1808

In accordance with section 87(2) of the Planning and Development Act 2005 the Minister for Planning approved the Town of East Fremantle local planning scheme amendment no. 12 on 20 October 2016 for the purpose of rezoning Lot 250 (No. 18) Dalgety Street, East Fremantle from ‘Public Purposes – Hospital’ to ‘Residential’ with a corresponding density coding of ‘R15”.

In accordance with section 87(2) of the Planning and Development Act 2005 the Minister for Planning approved the Town of East Fremantle local planning scheme amendment no. 13 on 20 October 2016 for the purpose of deleting entry numbers 1 and 2 in Schedule 4: Special Use Zones.
