On 11 May 2023 the WA Planning Commission granted a development approval for the construction of a mixed use development comprising of 93 apartments, a commercial tenancy, a café and open space with basement parking.

The Town has been advised that the Western Australian Planning Commission (WAPC) will be considering the Part 17 Significant Development proposal for The Entrance site at its meeting on Thursday, 11 May 2023 commencing at 1pm.

At its meeting in June last year, Council resolved to forward a submission on the significant development application for 'The Entrance' to the WA Planning Commission (WAPC). The submission expressed strong objection to the proposal and requested the WAPC refuse the application. Over past months, the State Development Assessment Unit (SDAU) and the State Design Review Panel (SDRP) have undertaken their assessment of the proposal and in due course the SDAU will make a recommendation to the WAPC which will then determine the application at an upcoming meeting. The SDAU will advise the Town when the matter is to be considered by the WAPC and the Town will inform the community through the usual communication channels. The WAPC meetings are open to the public and the public can make deputations.

Public advertising of the development application for 'The Entrance' closed on 2 June. At its meeting on 21 June 2022, Council resolved to forward a submission on the significant development application for 'The Entrance' to the WA Planning Commission (WAPC). The application was submitted to the State Development Assessment Unit (SDAU) and will be assessed/determined by the SDAU and the WA Planning Commission (WAPC) under the ‘Significant Development’ pathway in accordance with new planning legislation gazetted in July 2020.
The Town is only a referral body for this application, providing comment to the SDAU regarding the proposed development. It is not involved in the public consultation process. The Council is required to consider the proposal, and should it wish to do so, formally make a submission to the WAPC.
The Town’s officers do not have the authority under current planning legislation to make recommendations to the WAPC in relation to a development application. Also, the Town is not authorised to provide any information pertaining to this development application as directed by the SDAU. All advertising of the proposal and the final determination will be undertaken by the SDAU/WAPC. All enquiries about the application should be directed to the SDAU using the above link.
Advertising commenced today (Thursday, 5 May 2022) and will close on Thursday, 2 June 2022. All relevant documentation associated with the application is available to be viewed and downloaded via the above link.

A development application has been submitted to the State Development Assessment Unit (SDAU). The applicant has requested the development site at 91-93 Canning Highway, East Fremantle be known as the 'The Crossing'.
The development site comprises Lots 418 & 419 Canning Hwy, Lot 81 St Peters Road and Lot 423 King Street, East Fremantle. The development application was submitted in December 2021, but is yet to be advertised. The Town does not have a timeframe regarding the assessment of the application by the SDAU and determination of the application by the Western Australian Planning Commission. The application will be advertised to the community by the SDAU, and when invited, feedback on the proposal will be direct to the SDAU.

On 27 January 2021 the Minister for Planning granted final approval of Amendment No. 14 and the Amendment was gazetted on 5 February 2021 for the purpose of:
- Modifying Part 5 General Development Requirements of the Planning Scheme by inserting Additional Site and Development Provisions in Schedule 13 for No. 91-93 Canning Highway (comprising Lot 418 and Lot 419 Canning Highway, Lot 81 St Peters Road and Lot 423 King Street), to guide redevelopment of the land for mixed use and multiple dwelling purposes (commercial and/or apartments).
- The Site and Development Requirements will be listed in Schedule 13 and, amongst other things, will provide development controls for land use, density, plot ratio, building height and setback and additional height (Figures 1 and 2).

Outcome of Consideration of Schedule of Modifications and Schedule submissions
Council has now endorsed a recommendation for both Scheme Amendments.
At the Special Council Meeting of 7 August 2019 and the Ordinary Council Meeting of 20 August 2019, the Council resolved, pursuant to Section 75 of the Planning and Development Act 2005 and Regulation 41(3) (c) of the Planning and Development (Local Planning Schemes) Regulations 2015, to support complex Amendment No. 14 and No. 15 to Local Planning Scheme No. 3 subject to the modifications to the Schedules of Modifications (as directed for advertising by the Minister for Planning).

Background Information
In 2018 the Council adopted a major Amendment to its Planning Scheme for the Roofing 2000 site. The owner proposes the site be developed for high density residential and commercial uses so the Amendment was required to introduce building and parking development controls. The Amendment included controls relating to building height and setbacks, floor space, land use, overshadowing, vehicle parking and other matters.
The Amendment was then forwarded to the WA Planning Commission (WAPC) for its consideration. The WAPC made substantial changes to the Amendment most notably to the building height and setback controls allowing for a greater building height, lesser building setbacks than those endorsed by Council and the potential for additional building height under certain circumstances. These changes were then reconsidered by the Minister for Planning who has directed that the Amendment be modified and advertised for public comment for 28 days. Following the comment period the Minister will consider public comment (submissions) and Council’s recommendations prior to making a final decision.

SCHEME AMENDMENT No. 14 - ROOFING 2000 SITE, 91-93 CANNING HIGHWAY
Update - Wednesday 7 November 2018
Following Council adoption of Amendment 14 and 15 in May and June of 2018, Elected Members and the Town’s Officers have met with the:
- Minister for Planning;
- relevant Members of State and Federal Parliament;
- Chair of the Heritage Council;
- CEO of the State Heritage Office and heritage officers;
- Director General of the Department of Planning; Lands and Heritage; and
- Senior State Planning staff and the Chair of the Western Australian Planning Commission.
The aim of the meetings was to outline the basis and importance of the Scheme Amendments in relation to orderly and proper planning for the sites and to seek support for the Amendments.
The Town has liaised with community members and organisations who have expressed an interest in voicing their support for the Council’s Amendments. Meetings with the land owners of both Amendment sites and their representatives have also occurred as required.
Amendment 14 and 15 were considered by the Statutory Planning Committee (SPC) on 23 October 2018. At the meeting the SPC considered reports by Officers of the Department of Planning which did not support the Town’s Amendments and proposed substantial modifications to both Amendments. The SPC reports are confidential.
The Mayor, Deputy Mayor and Officers from the Town, as well as many community members, the land owners/developers and their representatives made deputations to the SPC (a sub-committee of the Western Australian Planning Commission (WAPC)) to speak both in support of and against the Town’s Amendments.
Following the meeting the Town was advised by the Department of Planning that the SPC determined to forward both Amendment 14 and 15 to the Hon. Minister for Planning for her consideration. The SPC’s decision is not publicly available as both Amendments remain confidential reports with the Minister.
Under the Local Planning Schemes Regulations 2015 the Minister, before making a decision on the Amendments, has the discretion to direct that modifications to the Amendments be advertised if the:
- WAPC recommends that the Amendment that was advertised be modified; and
- Minister is of the opinion that the modification is significant.
The direction from the Minister must include details of the process to be followed in respect of the advertisement including time frames for:
- the making and consideration of submissions on the modifications; and
- providing recommendations to the Minister following the advertisement.
If the Town is given a direction by the Minister it must advertise the modifications to the Amendment as directed. This includes when and for how long the Amendments will be advertised.
It is the Town’s understanding that both Amendments will be re-advertised.
Advertising for both Amendments could occur concurrently.
The Town intends to continue to keep the community updated throughout the Amendment process. When the Amendments are to be advertised the Town will post the details on the web site, write to land owners/occupiers within the Town seeking their comments and explain how to make a submission. Advertisements will also be placed in the local newspapers, in the Town's E-Newsletter (which is distributed electronically), on its Facebook page and through all other relevant advertising means considered suitable.
Following commencement of advertising the details of the modifications to the Amendments will be made available on the web site and at the Town’s administration office. The Town’s Planning Officers will also be available to discuss the modified Amendments and how to make a submission.

Amendment No 14 is currently being considered by the State Department of Planning; Lands and Heritage and may be subject to modification.
Amendment No. 14 was initiated in April 2017 and adopted by Council with modifications in May 2018. The Amendment was initiated by the land owner and prepared in consultation with the land owner’s representative following the Town’s agreement to proceed to amend the Planning Scheme.
Following advertising of the Amendment in 2017 the community submissions received expressed concerns regarding the erosion of the heritage character of the Precinct, the visually and physically imposing nature of the building envelope proposed, parking and traffic, access points, overlooking, privacy, landscaping, pedestrian access, retention of trees and other more general issues related to residential amenity.
Over the past year the Town has engaged at length and in collaboration with the owner’s representative regarding appropriate development controls. The Town also carried out independent built form modelling for the site using an urban designer. This work has assisted in the formulation of development controls that Council believe address the issues raised by the community and which strike a balance between the redevelopment objectives and the orderly and proper planning for the area. The adopted Amendment provisions were considered to address resident concerns but also facilitated a greater development potential than that currently possible under the Mixed Use zone classification of the land.
The intent of the Amendment is to provide a planning framework to guide redevelopment of the site for high density mixed use purposes. The Amendment finally adopted by Council would allow a 7 to (potentially) 8 storey building to the north of the site, facing Canning and Stirling Highway and building(s) of lesser height that is, 2 to 5 storeys, facing Sewell Street and St Peters Road. Basement parking would also be provided. The development controls are specific to land use, building height and setbacks, plot ratio, vehicle parking, traffic and noise management, access, residential development and density which could not be varied by the decision-maker. Detailed design proposals for a building/development on the site are not part of the Scheme Amendment.
